Justices Thomas, Samuel Alito and Neil Gorsuch have already indicated they’re sympathetic to the arguments of Moore v. Harper, which argues the Constitution gives state legislatures power over the rules for federal elections, and that those rules cannot be overruled by state courts or constitutions.
If the Supreme Court rules in favor of Moore, it would give state legislatures enormous and largely unchecked power to set all sorts of election rules, particularly by drawing congressional maps warped by partisan gerrymandering.
